RIGHTS OF ACCESS

Corporate Housing America, or our authorized agents, may at any time access the Apartment for the purpose of inspection of the Apartment, and to carry out repair or maintenance work. Corporate Housing America will make reasonable effort to give advance notice to the Guest(s).


Trip Charges

 If Corporate Housing America has made prior arrangements to access the Apartment and are denied access by the Guest upon arrival for any reason, a trip charge of $100 will be assessed to the Guest.


Parking

Parking varies by property and must be adhered to according to the provided Self Check-in Instructions. Onsite parking for one vehicle is included with the apartment as detailed in the Self check-in instructions. If additional parking is required, you must obtained approval and any necessary passes through Corporate Housing America. Guest may permit vehicles to be parked only in designated common parking areas and/or in any parking spaces reserved specifically for the Guest, or in the street if not prohibited by law. In most cases, an on-site management or other 3rd party that has authority over the parking areas affiliated with the parking area where the Apartment is located and may have its own specific parking rules that may be enforced by itself or another 3rd party at any time and it is the Guest’s responsibility to personally verify what areas and parking spaces that he or she is authorized to park in before attempting to park in them. It is also the Guest s responsibility to verify (before attempting to park in an area) with Corporate Housing America as to whether a parking sticker, parking pass or any or verification mechanism is required to park in any areas or parking spaces. If any such parking pass, parking sticker, or other mechanism is required it is the Guest s responsibility to display them or utilize them in the specific method required by any on-site management or 3rd party requires. Corporate Housing America is not responsible for any financial costs that the Tenant may incur from committing any parking violations during their stay in the Apartment including (but not limited to) towing and/or parking tickets.


While parking is available at all CHA locations, not all apartments have assigned parking spaces and the parking situation varies for each specific property. You will need to refer to your Self Check-in Instructions for information regarding the property you will be stay at. CHA is not responsible for stolen or damaged vehicles. Your vehicle may be towed if not parked in designated parking space. Any parking cards, garage openers, etc. not left in the apartment upon departure will result in an additional charge ranging from $50 to $175 depending on the specific item.

Vehicle Info:


The Client/Guest is responsible to register their vehicle make, model and license plate number with CORPORATE HOUSING AMERICA immediately upon arrival. Commercial vehicles, trailers, RVs, motor homes, etc. must request permission to park on any part of the premises before doing so. All vehicles must be in operating condition. No mechanical (including electrical or interior) repairs of any nature are permitted on the property at any time. No car washing allowed on the property.


The speed limit on the property is 10 MPH unless otherwise posted.

Loud vehicles and radios are strictly prohibited on the property. Please respect your neighbors and turn your radio down when driving on the property.


Parking

 is strictly enforced at all times and subject to towing without notice (AT THE OWNER’S EXPENSE) based on the following:

Parking in designated spaces only

No Parking in “Red Zones”.

No Parking in a covered or numbered space that has not been assigned to you and /or displaying the proper parking permit.

No blocking other vehicles at any time.

No parking in more than one space per vehicle

No non-registered parking on the premises without permission.


EMERGENCY

Personal injury, fire or criminal activity emergencies: Call 911

You must immediately notify CHA of any such call to 911. If no answer, make sure to leave a message on the CHA voicemail.

Contact CHA directly if a situation might cause harm or damage to people or property that would not qualify as a 911 emergency.


Non-Emergency

CHA is not responsible if you lock yourself out of the apartment. We will try to help if possible, but you may need to call a locksmith.


If the emergency is due to guest negligence or caused by the guest’s actions, applicable charges will be applied to your account.



LEGALEZE

All terms and conditions are subject to change without notice. It is the responsibility of the Guest/Cardholder to stay informed about new terms, conditions, rules and guidelines.

Agreement; Parties

Each occupant (“Guest”) and/or the corporate client (“Corporate Client”), to the extent that the Guest's reservation (“Reservation”) has been facilitated through a corporate relationship with Corporate Housing America LLC (“CHA”), agree to the terms and conditions set forth herein (“Terms and Conditions”) which shall apply to the Reservation for the Corporate Housing America Apartment (“Unit or Premises”) as specified in the online confirmation and/or e-mail confirmation (together, “Confirmation Documents”) provided to Corporate Client or Guest, as applicable. As used herein, “Client/Guest” shall refer to Corporate Client, as applicable, and each Guest. Client/Guest understands and agrees that units in certain Corporate Housing America markets (“Franchised Markets”) may be leased and/or managed by Corporate Housing America 's franchisees (“Franchisees”) and may be rented to Client/Guest by Franchisees in accordance with these Terms and Conditions. Client/Guest further understands and agrees that, in exchange for its ability to request a unit in a Franchised Market, it is acknowledging and agreeing that Corporate Housing America's obligations and responsibilities under these Terms and Conditions will be performed by a Franchisee. To the extent that the Unit for the Reservation is in a Franchised Market, Client/Guest agrees (i) to be bound under these Terms and Conditions to the Franchisee who provides the Unit, (ii) to look to the Franchisee for all obligations of the Corporate Housing America  (as defined below) under these Terms and Conditions, and (iii) that the Franchisee shall have all rights and obligations of the Corporate Housing America  under these Terms and Conditions. The parties understand and agree that these Terms and Conditions are expressly between Client/Guest, on one side, and Corporate Housing America or the Franchisee, on the other side, and explicitly not between Corporate Housing America, on one side, and the Franchisee, on the other side. As used herein, “Corporate Housing America” shall refer to Corporate Housing America or the Franchisee, as applicable.

INDEMNIFICATION

Tenant shall neither hold, nor attempt to hold, Corporate Housing America, Corporate Housing America’s agents, contractors or employees liable for any injury, damage, claims or loss to person or property occasioned by any accident, conditions or casualty to, upon, or about the property including, but not limited to, defective wiring, the breaking or stopping of the plumbing or sewage upon the property, unless such accident, condition or casualty is directly caused by intentional or reckless acts or omission of Corporate Housing America, notwithstanding any duty Corporate Housing America may have hereunder to repair or maintain the property, in the event that the improvements upon the property are damaged by the negligent, reckless or intentional act or omission of the tenant or any licensees, invitees or co-tenants, tenant shall bear the full cost of such repair or replacement. Guest/Occupant shall hold Corporate Housing, America Corporate Housing America’s agents and their respective successors and assigns, harmless and indemnified from all injury, loss, claims or damage to any person or property while on the property or any other part of the property, which is occasioned by an act or omission of the guest, guest’s licensees, invitees or co-occupants. Corporate Housing America is not responsible for any damage or destruction to the tenant’s personal property. Guest/Occupant shall obtain renter’s insurance at the Guest’s/Occupant’s sole discretion and expense.

Client/Guest agrees to defend, indemnify and hold harmless the Indemnified Parties from and against any claim or demand asserted by any third party due to or arising out of the use of the Internet service by Client/Guest.


Indemnification

Client/Guest hereby covenants and agrees to indemnify, hold harmless and defend Corporate Housing America , Marriott International, Inc., and each of their officers, directors, employees, agents, successors, assigns and all related parties (“Indemnified Parties”) from and against any and all claims, losses, or liabilities for injury or death to any person or for damages to or loss of use of any property arising out of any occurrence in, on or about the Premises or the surrounding area, building, grounds, or facilities, arising out of, incurred or suffered as a result of use or occupancy of the Premises by Client/Guest. Such indemnification shall include, without limitation, attorney's fees, investigation costs, and other costs actually incurred by any of the Indemnified Parties.


Attorneys'/collection fees

If any dispute arises concerning the terms of this agreement or the nonpayment of any sums due under this agreement, Corporate Housing America shall be entitled, in addition to other damages and costs, to recover reasonable attorneys'/collection fees.


Reserved rights

Absent written instructions on the contrary, resident hereby grants Corporate Housing America authorization to enter the unit under the following conditions: (a) to make necessary or agreed upon repairs, cleaning, alteration or improvements following resident's request or a 24 hour notice given by Corporate Housing America; or (b) emergency situations.

Corporate Housing America   reserves the right to request and process a criminal background check at any time on any guest/guarantor listed on this agreement. If a background check is required the guests’ social security number will be requested and used to run a national criminal background check. Failure to provide a social security number if requested could result in immediate termination of the contract.


Severability


If any term, provision, covenant or restriction of this Agreement is held by a court of competent jurisdiction to be invalid, illegal, void or unenforceable, the remainder of the terms, provisions, covenants and restrictions set forth herein shall remain in full force and effect and shall in no way be affected, impaired or invalidated, and the parties hereto shall use their commercially reasonable efforts to find and employ an alternative means to achieve the same or substantially the same result as that contemplated by such term, provision, covenant or restriction. It is hereby stipulated and declared to be the intention of the parties that they would have executed the remaining terms, provisions, covenants and restrictions without including any of such that may be hereafter declared invalid, illegal, void or unenforceable."


Miscellaneous

If a legal dispute arises over the terms or performance of this contract, the prevailing party shall, at trial or after arbitration, be entitled to its reasonable attorney fees, including appeal. I have read and initialed the contract, policies & guidelines of ‘cha’ and agree to all of the terms.  I understand that i am responsible for maintaining the care of the unit and authorize any unpaid charges or damages to be billed to me and /or my credit card as needed.  Any disturbance, non-compliance or Illegal activity of any kind may result in immediate legal action to vacate the property. Tenant is responsible for making arrangements to collect belongings from CHA.
